What do you think about my husband texting another women?

We were thinking about divorce, but we decided to fix our marriage. I found out that my husband has been texting some other women after the fact we were trying to fix our marriage. He told me the girl was his waitress when he went out with his friends on Thursday night. The waitress gave my husband the number and my husband decided a couple days later to text her. I was being noise and checked through our cell phone records and I saw a number I didn’t recognize. I decided to confront my husband about the number. I told him not to lie to me. I searched the number on a search engine and found out it was some girl’s number. What made me want to check our cell phone bill was because I looked at the history on the computer and noticed my husband was looking up divorce lawyers after the fact we agreed to fix our marriage. I was looking into history for a site I looked up the day before. It made me think he might be seeing someone. He has just been texting this girl for a week and half and he never once called her. He told me that he ended with her because he really wants this marriage to work. What really confuses me is that we have been trying for a baby this whole time. I told him he made a mistake and we will put this behind us. I told him I love him and I want to fix our marriage. He told me, that texting the girl was not cheating because he was thinking about divorcing me. We have been married for two years. What’s causing him to want divorce me is that I nag on him, yell at him, get mad at the smallest thing that’s not going to amount to anything and most of all I hate that he has to go out every Thursday night with his friend’s. If he stayed home one day on a Thursday, I would feel like I won the lottery. In my dreams that would happen. I told him that I want to talk about what happened and that when he goes out on Thursday I am going to get on to him to make sure that he is not meeting that girl. With my gut I feel all he did was text her and I know it was exciting for him to talk to a girl and I have no clue. My husband and I both know for now on I will be checking our cell phone bill information. What do you think?

We never filed our marriage license in Texas. Is the marriage valid?

In 1996, my ex and I obtained a marriage license, had a ceremony with the justice of the peace, and the license was signed. We were told to officially record it and we did not do so. Not on purpose.. just both slackers really and forgetful. We never received any certified copy. We were together for 7 years, had a child, and split up 3.5 years ago.

Were we ever legally married? Do I need to get a divorce? The question has come up now as I’d like to buy a home and the mortgage broker asked if I’d ever been married and if so, when was I divorced. I’m not sure what to tell him!

I’ve called the county and the state and they both say I need to ask a lawyer. When I searched the county records a few years ago I found no record of our marriage. What does this mean? Does the common law thing apply instead? If so, do I still have to get divorced?
